Privacy Policy

Pursuant to Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of natural persons in the processing of personal data and on the free movement of such data, which repeals Directive 95/46/EC (General Data Protection Regulation „GDPR“).

As a data subject, by clicking on the „Subscribe“ button, I give my consent to the company UP KABINET s. r. o. (hereinafter „Operator“), Námestie sv. Egídia 62/48, 058 01 Poprad, ID: 55 119 174 with the processing of my personal data to the extent of:

  • name and surname,
  • e-mail address

for the purpose of sending information emails (newsletters). I am aware that within the scope of sending newsletters, the company UP KABINET s. r. o. may additionally obtain information about my activities (called „usage data“) about whether I open the newsletter, whether and what and how many times I click on delivered links, IP address, localization data, language settings. I grant this consent for the duration of the newsletter services. After this period, personal data will be destroyed. 

The personal data obtained is not subject to profiling or automated decision-making.

The operator informs the affected person that personal data is subject to cross-border transfer to the USA. Mailchimp is provided by The Rocket Science Group, LLC d/b/a MailChimp, 512 Means St., Suite 404, Atlanta, Georgia, which has acceded to the “EU U.S. Privacy Shield“ (in the area of personal data processing, the so-called safe shield). The provision of personal data, as well as the granting of your consent to their processing, is voluntary. You can revoke your consent at any time in every received email via the unsubscribe link or at the address kabinet@upkabinet.sk. The withdrawal consent is effective on the day of its delivery.

Granting consent does not affect your rights as a data subject. Based on a written request or in person at the operator, you have the right to:

• request access to your personal data and correction, deletion, restriction of processing of your personal data, withdraw consent at any time;

• on portability of personal data;

• file a proposal to initiate proceedings at the Personal Data Protection Office of the Slovak Republic.

Right to withdraw consent

If your personal data is processed based on your consent, you have the right to revoke this consent at any time. You can withdraw your consent electronically in every email you receive via the unsubscribe link, at the address of the responsible person, in writing, by means of a notice of withdrawal of consent, or in person at the address of the operator’s registered office.

Right to repair or change

It is important that we have correct information about you and we ask that you notify us if any of your personal data is incorrect, e.g. if you have changed your email address.

Right to restriction of processing

From the moment you requested the correction of your personal data, until we can confirm the accuracy of your personal data (or change them according to your instructions), you are entitled to limited processing. This means that we (with the exception of personal data storage) can only process your personal data in accordance with your consent or if necessary in connection with legal claims, to protect someone else’s rights. You can also request that we restrict the processing of your personal data if the processing is unlawful, but you do not want us to delete the personal data.

The right to object to processing

As a data subject, you do not have the right to object to the processing of personal data due to the legal basis according to Art. 6 par. 1 letter a) GDPR.

Right to data portability

You can request that your personal data, which you have provided us for processing on the basis of consent, which are processed automatically (not in paper form), be provided in a structured, commonly used and machine-readable format. You also have the right to request the transfer of this information to another operator if this is technically possible.

Right to Erasure

If we process your personal data in an illegal manner, for example if we process your personal data for longer than necessary or without reason, you can ask us to delete this data.

Right of access

You can request information about how we process your personal data, including information about it.

The right to file a motion to initiate proceedings on personal data protection

If you believe that your personal data has been processed unfairly or illegally, you can file a complaint with the supervisory authority, which is the Personal Data Protection Office of the Slovak Republic, Hraničná 12, 820 07 Bratislava 27; tel. number: +421 /2/ 3231 3214; e-mail: statny.dozor@pdp.gov.sk.

The person concerned declares that the personal data provided are true, up-to-date and were freely provided.
